- Jennifer G., a thirty year old female from Louisville, Kentucky, voluntarily admitted herself to Ten Broeck Hospital due to depression and alcohol abuse issues following a terrible break up with her fiancée. Jennifer was placed in the co-ed adult patient unit, where she was repeatedly assured that she was in a safe environment. After approximately ten days at Ten Broeck and days before she was to be released, Jennifer was sexually assaulted by a male patient at Ten Broeck. Not only did Jennifer incur additional medical expenses, but she suffered extensive psychological and emotional trauma. We represented Jennifer in the sexual assault action against Ten Broeck due to their negligent supervision, violation of their own policies and procedures related to patient monitoring, and insufficient policies and procedures to adequately protect patients such as Jennifer. In addition to filing the lawsuit on Jennifer’s behalf, we retained an expert on workplace safety and security specifically related to safe environments for treatment of mental health issues. The case was mediated and reached a confidential settlement.
