Beware of texting truck drivers

It is dangerous for all drivers to text or otherwise interact with their phones behind the wheel. But when it's a commercial semitruck driver who is doing the interacting, it can be especially deadly simply because of the sheer size and weight of the trucks.

Both the Pipeline and Hazardous Materials Safety Administration (PHMSA) and the Federal Motor Carrier Safety Administration (FMCSA) prohibit the use of handheld cellphones for bus drivers, interstate truckers and those transporting placardable quantities of hazardous materials.

The prohibitions are handed down from the federal Department of Transportation in a concerted effort to eliminate distracted driving. Those who violate the law face fines and may also be disqualified from driving commercially in the United States.

The prohibitions actually go much farther than just texting bans. Any interactions with handheld devices are prohibited unless they can be accomplished by pressing a button once. Drivers may still use hands-free electronic devices and earpieces for phone conversations while driving.

So what can motorists do if they suspect or realize that the wreck that injured them was caused by a commercial truck driver who was engaged with their cellphone while barreling down the highway or interstate?

Certainly, that information should be shared with the police officer who responds to the initial accident. In some cases, that may be enough to start the ball rolling and getting corroboration that proves the allegation.

But in some cases, your words may fall on deaf ears. In those circumstances, it may be necessary to inform your Louisville personal injury attorney. They will then seek to prove your allegations were true through the discovery process of the personal injury claim that you file.
