Slip and fall accidents and nursing homes

There are lot of things that can go wrong in medical facilities, including nursing homes. The residents are often elderly, unstable on their feet and prone to slipping and falling. A qualified nursing home, therefore, would take many precautions with residents to prevent the chances and risks of someone slipping and suffering serious injuries.

However, not all nursing homes are diligent in this regard. Some patients could suffer the consequences of a negligent nursing home that fails to keep its premises safe and free of slipping dangers.

Considering that nursing home residents are prone to slipping and falling to begin with, an injury lawsuit related to a fall might not be entirely straightforward to pursue. For example, imagine a patient who needs to use a walker to move around the facility. However, he leaves his walker in his room and then slips on a wet spot that the nursing home failed to clean up? Who is at fault and liable? Perhaps both parties are liable to some degree.

The injured resident might have a claim to pursue against the nursing home for its failure to clean up the mess, which caused him to fall, but the nursing home may not be 100 percent liable since the man may have also been to blame for failing to use his walker. However, what if the nursing had the ability to stop the man and prevent him from walking without a walker, but failed to do so? In this case, maybe nursing home will be liable for the full amount of damages.

Every nursing home slip and fall case needs to be evaluated on its unique factual scenario. If you or a loved one was injured in such an incident, a personal injury lawyer can review the circumstances and extent of your injuries to determine whether you have a viable claim for damages.
